Commercial Commission TOS

1. General InformationThese Terms of Service govern the commercial commission process for art created by Kael (referred to as "Artist"). By commissioning artwork, you agree to these terms. For discounted bulk commissions, please keep an eye on my Ko-Fi.2. Commission Process- Requesting a Commission: Clients must submit a request via [email protected] or by messaging kael.pxl on discord, including details about the desired artwork. Please include the following in the initial message:
-- Your preferred payment method and the email attached to that payment method so an invoice can be sent.
-- Text explanation of what you’re looking for.
-- Clear reference sheet or reference image of your character.
-- Deadline, if any.
- Quotation and Agreement: The Artist will provide a quote based on the request.3. Payment Terms- Deposit: A deposit of 50% is required before work begins. The remaining balance is due upon completion of the artwork.
- Payment Methods: Payments can be made via PayPal or Stripe. Venmo is also available for friends of the artist.
- Refund Policy: Once the artwork has started, the deposit is non-refundable. If the commission is canceled before work begins, the deposit will be refunded.4. Artwork Rights- Copyright: The Artist retains all rights to the artwork, including the right to display it in portfolios and online galleries. Clients will receive all original sized digital files and any project files associated with the project. Clients may request versions of the work exported in any resolution.
- Usage: Clients may use the artwork for commercial purposes as long as the artist is credited. Clients may not use artwork in AI or NFT.
- If artwork needs to be edited or remade by another artist, please keep the artist as the original credit. But otherwise editing is ok.5. Revision Policy- Sketch Revisions: Clients are entitled to 2 free revisions during the sketch phase. These may include scrapping all sketches and reciving full redraws.
- Additional Revisions: Any additional revisions or changes after the sketch approval will incur an hourly fee of $35 usd.
- To limit the number of revisions needed, be thorough with references. If you have an exact image in mind, a stick figure drawing in MsPaint is always appreciated.6. Completion Time- Estimated Timeframe: Artist will provide an estimated completion date based on the workload. Delays may occur, and clients will be notified promptly.
- Rush Orders: Due to Kael's current condition, rush orders are unavailable.7. Cancellation Policy- Clients may cancel their commission at any time before work begins. If work has commenced, the deposit will not be refunded.
- Do not file a chargeback instead of requesting a refund, as this can cause major issues. If a chargeback is filled without first contacting the artist, the deposit will be kept and the client will not receive their work.
- If a chargeback is filled after receiving art, art can be resold by the artist.
